Constitution
Preamble
We, the
interested parties of the United States Military
services stationed in Hohenfels Germany, having
formed First in Battle Chapter the Association of
the United States Army for the furtherance of the
efficiency of the United States Army components of
the armed Forces, our country and by local action
to further the aims and objectives of the
Association of the US Army and promoting foreign
relation, announce the objectives of the
Association as follows:
A: To organize members and
to promote the United States Army in Europe. To
include assisting our community, when ever possible
(NAF activities.).
B: To develop and encourage
attitudes of fairness, good sportsmanship, and
fellowship among members of the Chapter.
C: To cooperate with us
forces in Europe, and all people governments under
whose jurisdiction we perform for the purpose of
improving community relations.
D: To maintain a good
relationship between AUSA members and the First in
Battle Chapter management.
E: To give
information to the Association Chapter members
concerning the dates, locations of the events, and
other particulars in which members are interested.
F: To keep accurate
records of all the events of the Chapter.
Article
I:
Name, Location, Jurisdiction, and
Status.
Section
1: The
name of the Association will be, First in Battle
Chapter of the Association of the United States
Army.
Section
2:
Persons eligible for membership to the First in
Battle Chapter of the Association of the United
States Army will be the Hohenfels, Vilseck and
Grafenwöhr
Communities,
or adjacent to, but not to overlap another AUSA
Chapter area. Except with the written permission
from the Board of Directors of the adjacent area
and the approval of
the AUSA Board of Directors.
Section
3: The
AUSA and this Chapter are under the jurisdiction of
the Commander and Chief, United States Army Europe,
and the seventh army of his designated
representative, and his established pursuant to AER
210-22, IMA-E Private Organizations and Fundraising
Policy and Department of Defense Instruction DODI
1000.15.
Let it be known the AUSA and this Chapter is under
the approval authority of the UASG Commander.
Section
4: This
organization is established IAW AER 210-22,
Department of Defense Instruction DODI 1000.15 and
the USARUER Private Organizations and Fundraising
Policy.
This organization is not an instrumentality of the
United States. Will be self –sustaining, and may
not receive financial assistance from the US Army
or Non-Appropriated funds.
This organization will not in any way duplicate or
compete with a Non-Appropriated fund
instrumentality operation or appropriated fund
government function. Neither the
Department of the Army Nor IMA-E will assume any
responsibility for this organization’s debts. This
organization does not discriminate in membership on
the basis of Race,
color, religion, national origin, sex, or mental or
physical handicap.
Section
5: The
Hohenfels Chapter fully supports the IMA-E policy
on equal opportunity and will not discriminate in
membership of eligibility on the basis of race,
religion,
national origin, or sex. This organization will
neither accept invitations from, nor participate in
any activity or organization that does not conform
to IMA-E Policy, or that
discriminates on any bias mentioned previously.
Section
6: All
members are required to read the constitution, and
by-laws on joining the organization.
Article
II:
Purpose and Objectives
The
purpose of the First in Battle Chapter is to
develop and maintain the furtherance of the
efficiency of the Army components of the Armed
Forces, our country
and by local action to further the aims and
objectives of the Association of the US Army and
promoting foreign relation. It will Benefit and
expand foreign relations, and to
further encourage members to participate more in
community activities and to compete with those of
any appropriated or Non-Appropriated fund (NAF)
activity. The objectives
of the Chapter are as stated in the preamble of the
constitution.
Article
III:
Activities
These
activities will consist of factual participation,
films, clinics, and lectures, involving the Voice
for the Army and Support for the Soldier. Fund
raising for NAF activities
and assisting local community’s relations will also
be included.
Article
IV:
Membership
All
Chapter members will be up-to-date members of the
AUSA, and in good standing.
Section
1:
Membership of the Hohenfels Chapter will be
voluntary, and consist of the following:
A: Active members:
Membership normally will be restricted to members
of the US Forces, DA civilian employees. Family
members (dependents of members of the household
of sponsors stationed is IMA-E), and US forces
contract employees of organizations granted status
under Article 71, 72 and 73 of the supplementary
agreement to the NATO
status of forces agreement (SOFA) (referred to as
identification (ID) card holders)
B: Associate members:
Residents of Germany, Holland, Belgium,
Switzerland, France, Italy, England, and all other
NATO forces country’s military personnel, and their
dependents, and employees of the stock contractor.
C: Honorary members:
Presented to individuals who have given the AUSA
support and/or services, subject to the approval of
the elected Board of Directors.
Section
2:
Active and Associate members are divided into three
groups as follows.
A: Participants: members
who pay membership fees.
B: Family members: Spouse
and family member of the above.
C: Members will consist of
a majority (51 percent) of ID card holders from the
above categories.
Section
3:
All active and associate members must sign a
release form releasing the AUSA and The First in
Battle Chapter of all responsibilities for any
injuries sustained during
an event, including that of a spectator.
Section
4:
Active and associate members will be current
members of the AUSA, and in good standing. Also,
all members and/or guest must abide by all rules,
regulations, and
the code of conduct, of the AUSA. (See by-laws)
Section
5:
All members are encouraged to attend Chapter
meetings. Notification of all activities will be
announced to each member.
Section
6:
Any members, who wished to withdraw from the
Association, may do so by giving a written request
to the secretary of the AUSA.
Article
V:
Government
Section
1: The
composition of the Chapter governing body will be
the Board of Directors consisting of a President,
1st
Vice-President,
Vice-President for Corporate Affairs,
Secretary, and treasurer.
A: When vacancies occur during the
course of the Operating Year, a special membership
meeting will be called.
B: A Quorum will consist of
three-quarters of the total members, who are in
good standing.
Article
VI:
AUSA
Hohenfels Chapter basis.
Section
1:
The First in Battle Chapter will not be allowed to
accept a sponsorship of financial assistance
without the consent of the AUSA Board of Directors.
Section
2: In
the case that the Chapter funds a military
community affair, all money must be properly
accounted for. All funds or profits will be used to
benefit the military
community, for NAF activities the exceptional
family member program of the child development
center, are recommended to receive donated funds of
the Chapter.
Section
3: All
equipment will be privately owned, and not the
property of the Chapter, this excludes any and all
supporting aids.
Article
VII:
Disciplinaire Actions
Section
1:
Disciplinary actions against members of the Chapter
will be referred to the AUSA Board of Directors,
and their decision will be final.
Section
2: The
Chapter can be disbanded by the AUSA Board of
Directors for gross infarction of the AUSA rules
and regulations for the misconduct of the Chapter
members
that could bring discredit to the good name of the
AUSA.
Article
VIII:
Amendements
Section
1: A
quorum of the total members in good standing at a
Chapter membership meeting, must vote in favor of
any changes and/or, amendments of this constitution
and
by-laws. All changes and amendments are subject to
the final approval by the AUSA Board of Directors,
and by the Community Commander.
This revised constitution, effective the date of
approval, superseded all previous constitutions.
